Terms of Service

Payments & Booking

• All sessions, packages, or custom work must be booked in advance.
• A 50% non-refundable deposit is required to confirm the booking.
• The remaining balance is due prior to delivery of digital images or galleries.
• Deposits and payments secure your date and the photographer’s time; no work will be scheduled or delivered without the deposit.

Delivery

• Digital images are delivered via secure online gallery or download link within the agreed timeframe.

• Download links remain active for 7 days unless otherwise noted. Clients are responsible for retrieving and backing up files.

File Retention & Backup

• CANAL GILLES MEDIA mantains backup copies for a limited period (typically 30 days).

• Clients are responsible for long-term storage.

Cancellations & Refunds

• Payments are non-refundable once images are delivered.

• Cancellation prior to a shoot may result in a non-refundable deposit as outlined in the invoice.

Image Selection & Editing

• Photographer exercises professional discretion in selecting and editing images. Raw or unedited files are not provided unless expressly agreed.

Promotion & Portfolio Usage

• Photographer may use images for portfolio, marketing, or promotional purposes unless the client requests otherwise in writing prior to delivery.

Limitation of Liability

• In the event of equipment failure, data loss, or other unforeseen circumstances preventing image delivery, the photographer’s liability is limited to the refund of payments received.

• Photographer is not liable for incidental or consequential damages.

Copyright

• All images remain the intellectual property of CANAL GILLES MEDIA unless a written Copyright Transfer Agreement is executed.

3. Digital Image License

Ownership & Grant of Rights

• Images remain the intellectual property of CANAL GILLES MEDIA.

• Upon full payment, clients are granted rights according to the license type (Personal or Commercial).

Personal Use License (Default)

Clients may:

• Copy, print, share, and store images for personal, non-commercial use.

• Share images with family, friends, or participants of the event.

• Post images on personal social media or websites.

• Make minor edits for personal presentation.

Commercial Use License

Clients commissioning photography for business or branding purposes may:

• Use images in digital and print media for marketing, promotion, or business operations.

• Modify or crop images for layout and presentation.

• Share images internally or with approved external partners as needed for business use.

Restrictions

• Images may not be resold, sublicensed, or used outside the scope of the license granted.

• Images may not be edited in a way that misrepresents the photographer’s style or work.

• Photographer credit is required where reasonable and possible.

Copyright Transfer Option

• Full copyright ownership may be transferred via written agreement and additional fee.

4. Privacy Policy

• Personal data (name, email, payment information) is collected solely for booking, payment processing, and delivery of services.
• Data is not sold or shared outside necessary processing partners.

• Clients may request deletion of personal data in accordance with applicable privacy laws.

5. Client Examples / Scenarios

1. Family/Friend Discount Applied

• Standard session rate: $300

  • Family/Friend Discount: 50%

  • Client pays $150 deposit to book → $150 remaining balance due before gallery access

2. Rescheduling a Session

• Client contacts photographer 7+ days before session: reschedule allowed without losing deposit

• Client contacts photographer <7 days before session: deposit is non-refundable, balance adjusted for new date

3. Partial Delivery / Album Upgrade

• Standard gallery includes 30 edited images

• Client opts for additional images or album: additional fees calculated and invoiced separately

• Full-resolution downloads for new items enabled only after payment

4. Payment Processing Fees

• Invoice total: $150

• Optional Stripe/PayPal processing fee: 3% ($4.50) added to invoice

• Total client pays: $154.50

5. Commercial Use License Example

• Client hires photographer for social media content

• License allows posting images on website, social platforms, and email marketing

• Images may not be sold to third parties or misrepresented

6. Personal Use License Example

• Client books a family session

• Images may be printed, shared with relatives, or posted on personal social media

• Images may not be sold or used for commercial purposes

7. Late or Delayed Payments

• Payment must be received in full before gallery access or print fulfillment

• If payment is delayed beyond the agreed date, delivery of digital files or prints is postponed until payment clears

8. Cancelled Prints or Orders

• Once a print or product order is placed and processed, cancellations are not eligible for refund

• If the print has not yet been processed, partial refund may be possible at photographer’s discretion

9. Delivery Issues / Print Errors

• The photographer is not responsible for misprints, shipping damage, or defects caused by the print vendor

• The company is happy to assist with legitimate issues, e.g., missing prints, obvious printing errors, or damaged items during shipping

• Minor preferences (gloss vs. matte, color tone subjectivity) are not considered valid defects
